Types of USA Immigration Visa

1: Immigrant Visas (Green Card):

What are the US Immigrant Visa Types?

The Immediate Relative visas and Family immigrant visas means that you are joining your close family who live in the US permanently. This can be your parents, fiancé, or spouse. If you have family in the US, or you become engaged or married to a US citizen, then you are eligible for this category of immigrant visas.

The US employer sponsored visas are immigrant visas which allow its holders to work permanently in the US. The US government limits the number of employment based visas that they give to around 140,000 per fiscal year. Below shows the different types of employment based visas.

USA EB-3 Immigration program

The EB-3 visa is an employment-based immigration visa that is available to foreign workers who have skills, education, or experience that are in demand in the United States. The EB 3 program is broken down into three categories:

Skilled Workers: This category is for individuals who have at least two years of experience in a skilled occupation and who have been offered a permanent job in the United States that requires those skills.

Professionals: This category is for individuals with bachelor’s degrees and who have been offered a permanent job in the United States that requires a degree.

Other Workers: This category is for individuals who are doing unskilled labor, have less than two years of experience, and have been offered a permanent job in the United States that requires that labor.

There is no minimum investment required like there is for the EB 5 program. Though it is generally considered to be more accessible than other employment-based immigration programs.

USA EB-5 Immigration Program

This Eb-5 visa program has become a popular option for wealthy individuals and families looking for immigration to USA. immigration to USA. EB-5 Immigration Program is an investment-based program that allows foreign nationals to obtain a green card through investment. To be eligible for the EB-5 program, an investor must invest a minimum of $1.8 million (or $900,000 in a targeted employment area) in a new commercial enterprise that creates at least 10 full-time jobs for U.S. workers.

One of the major benefits of the EB-5 program is that it provides a fast track to permanent residency in the United States. Foreign nationals who invest in the program can obtain a conditional green card within 18-24 months, and then apply for permanent residency after two years.

USA E-2 (Employment Second Preference)

The USA E-2 visa is a non-immigrant visa that allows foreign entrepreneurs to enter and work in the United States. This visa is an excellent option for investors, executives, and other highly skilled workers who are looking to establish a business in the United States.

The USA E-2 visa is not a permanent residency visa, and as such, the visa holder must regularly renew the visa. The visa is typically granted for a period of two to five years, depending on the Immigration officer’s discretion. However, the visa holder may renew their visa an unlimited number of times, provided they continue to meet the visa criteria.

  1. Establish, direct and operate the proposed business in the United States.
  2. Spouse of E-2 investor shall be granted E-2 dependent visa through which he/she may obtain temporary work permit or employment authorization document (EAD).
  3. Children under 21 years of age shall also be granted E-2 dependent visa allowing them to attend school of their choice in the United States.

Visa Validity:

  1. E-2 visa holders shall be allowed a maximum of two years stay in the United States initially.
  2. E-2 visa holders may request for extension in visa and obtain increment of up to two years. (There is no maximum limit for the number of extensions).

EB-2 NIW Visa

An EB-2 visa is an employment-based visa intended for those who either have an advanced degree or exceptional ability. Applicants who fall into one of these categories and whose employment would be in the national interest of the United States may apply for a national interest waiver (NIW) as a part of their EB-2 petition. With an EB-2 NIW visa, the applicant is considered a lawful permanent resident of the USA. The NIW allows the applicant to file this petition on their own behalf — without a job offer and without first acquiring a permanent labor (PERM) certification. The overall processing time for EB-2 NIW is  10.5 to 26.5 months from anywhere you apply. 

EB-2 NIW Eligibility Requirements

Since the National Interest Waiver is a subcategory of EB-2, you are legally required to meet the qualifications for the first two subcategories of the EB-2 visa. You must then present further evidence as to why your work can be used on a national level.

There are base criteria for EB-2 visas for either the advanced degree or the exceptional ability subcategories, including the following. For an advanced degree, you must have a U.S. advanced degree or a foreign equivalent. You must also have letters from your future or current employer. For exceptional ability, you must have a significant level of expertise in your field of work and meet EB-2 criteria.

To successfully obtain an NIW, the applicant must show:

  • That their proposed endeavor is of “substantial merit and national importance”
  • That they are “well-positioned” to execute their proposed endeavor
  • That, on balance, it would be in the national interest to waive the job offer and PERM certification requirements
